Town Centre is getting smaller

Kāpiti Coast District Council have been instructed in a High Court ruling by Justice Alan MacKenzie to offer back unrequired Town Centre land to the Ngahina Trust.
The claim is part of a 16 hectare block acquired by KCDC under the Public Works Act and includes 2 hectares KCDC had set aside for the proposed Aquatic Centre.
Justice MacKenzie said the lad was acquired for public works and not all of the land was now required for that purpose. He said the Council was now oblidged to decide which parts of the land were no longer required and offer the land back to the Ngahina Trust.
KCDC Chief Executive Pat Dougherty said the decision was complex and Council will seek advise from their solicitors.
